Indonesia Requires E-Commerce to Partner with Customs

Ministry of Finance Regulation No.96/2023 on Customs, Duty and Tax Provisions on Exported and Imported Consignment Goods, signed on September 15, requires e-commerce (e.g., online retails and marketplaces) to partner with the Directorate General of Customs and Excise (DGCE). This is mandatory for import transactions of more than 1,000 shipments within one calendar year. The DGCE will inspect the e-commerce transactions via computerized system periodically and issue a notice to the concerned e-commerce providers to file a partnership confirmation within 10 days. Consequently, e-commerce must exchange e-catalogue and e-invoice of the shipped goods with DGCE including data such as merchant’s ID, goods description, country of origin, price, etc. This regulation was ratified on September 18 and will come into effect in 60 days, replacing MOF Reg No.199/2019. This also applies retroactively and all e-commerce providers with more than 1,000 shipments in a year would have to partner with DGCE within the next 4 months since the regulation takes effect.v
